Terms of Service

1. Acceptance of Terms

By signing up for or using PerkBase ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not access or use the Service.

2. Description of Service

PerkBase provides a loyalty and marketing platform that helps local businesses capture leads, automate email campaigns, collect Google reviews, and manage customer relationships. The Service is offered as a monthly subscription with additional paid email credit packs.

3. Subscription and Fees

The Starter Plan is billed at £39 per month. A one-time setup fee of £100 applies at registration. You may purchase additional email credit packs at £10 per 1,000 credits. All fees are billed in GBP via Stripe and are non-refundable except where required by law.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

4. Your Responsibilities

You are responsible for maintaining the accuracy of your business information, for obtaining consent from your customers before adding them to your loyalty programme, and for complying with all applicable data protection laws including the UK GDPR and the Data Protection Act 2018.

You agree not to use the Service to send unsolicited marketing emails, to upload unlawful or infringing content, or to misuse the platform in any way that could harm PerkBase or its users.

5. Data Protection

We process personal data in accordance with our Privacy Policy. You remain the data controller for any customer data you upload, and PerkBase acts as a data processor on your behalf.

6. Acceptable Use Policy

You may not use the Service to send spam, to store unlawful content, to attempt to gain unauthorised access to other users' data, or to interfere with the proper functioning of the platform. Violations may result in immediate account suspension.

7. Intellectual Property

PerkBase and its content, features, and functionality are owned by PerkBase and are protected by UK and international copyright, trademark, and other intellectual property laws. You retain ownership of all customer data you upload to the Service.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, PerkBase shall not be liable for any indirect, incidental, or consequential damages, or for any loss of data or profits arising from your use of the Service.

9. Termination

We may suspend or terminate your account if you breach these Terms. You may cancel your subscription at any time through the platform or by contacting support.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through the platform. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
